What is DWI?
In North Carolina, a person is guilty of DWI (Driving While Impaired) if the State proves beyond a reasonable doubt that you drove or operated a motor vehicle:
While under the influence of an impairing substance; OR
With an alcohol concentration of 0.08 or more (.04 in a commercial vehicle); OR
With any amount of a Schedule I controlled substance or its metabolites in your blood or urine

Officers who investigate drivers for possible impairment are required to attend DWI Detection and Standardized Field Sobriety Testing training through the National Highway and Traffic Safety Administration (NHTSA). I have all of the NHTSA training manuals and resources that officers receive. I use these resources in court during cross-examination of officers to challenge the credibility and reliability of their testimony. Some of the possible pre-trial motions that I can file and argue on your behalf include:
- Motion to suppress evidence because there was no reasonable suspicion for the officer to stop your vehicle
- Motion to suppress evidence because the officer lacked probable cause to arrest you
